2. Eligibility and Age Requirements

If you are not old enough to enter into a binding contract where you live, a parent or legal guardian must review and agree to these Terms on your behalf and is responsible for your use of the Services.

3. Account Setup and Security

• The legality of Customer Content
• Having all necessary rights/permissions to use and host it
• Moderating any user-generated content you allow others to create or upload through your Services

D. Backups

You are responsible for maintaining your own backups of important data. Any backups we may provide (if available) are provided on a best-effort basis and are not guaranteed.

6. Payments, Billing, and Renewals

If you purchase paid Services, you agree to:

• Pay all applicable fees and taxes displayed at checkout or otherwise provided to you
• Keep your billing information current

If your plan renews automatically (where enabled), you authorize us (or our payment processor) to charge your selected payment method at each renewal period unless you cancel before renewal.

If a payment fails or is overdue, we may suspend or terminate the affected Services.

Refunds: Unless required by law, fees are generally non-refundable once paid. If we publish a separate refund policy for a specific product or plan, that policy will control for that product or plan.

7. Suspension and Termination

A. By you

You may stop using the Services at any time. If account tools are provided, you may be able to cancel through them.

B. By us

We may suspend or terminate your access to the Services (in whole or in part) if:

C. Effect of termination

Upon termination, your access ends and your Customer Content may be deleted as part of normal operations. You are responsible for exporting/backing up any data before cancellation or termination.

The Services, website, branding, and all related software and materials are owned by HytaleHosting or its licensors and are protected by intellectual property laws.

You may not copy, modify, resell, reverse engineer, or attempt to extract source code from the Services except to the extent such restriction is prohibited by law.

If you provide feedback or suggestions, you grant us the right to use them without obligation to you.

9. Third-Party Services

The Services may integrate with or link to third-party products or services. We do not control third parties and are not responsible for their content, policies, or practices. Your use of third-party services is governed by their terms.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Services will be uninterrupted, error-free, or completely secure.

11. Limitation of Liability

To the maximum extent permitted by law, HytaleHosting will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption.

To the maximum extent permitted by law, our total liability for any claim relating to the Services will not exceed the amount you paid us for the affected Services in the 3 months prior to the event giving rise to the claim.

Some jurisdictions do not allow certain limits, so these limitations may not fully apply to you.

12. Indemnification

You agree to indemnify and hold harmless HytaleHosting and its owners, operators, affiliates, and employees from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Services
• Your Customer Content
• Your violation of these Terms or applicable laws

13. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where HytaleHosting is established, without regard to conflict of law principles.

You and HytaleHosting agree to attempt to resolve disputes informally first. If a dispute cannot be resolved, it may be brought in the courts of a competent jurisdiction, unless applicable law requires otherwise.

Nothing in these Terms limits any consumer rights you may have that cannot be waived under applicable law.

14. Miscellaneous

• Entire Agreement: These Terms (and any linked policies) are the entire agreement regarding the Services.
• Severability: If any provision is unenforceable, the rest remain in effect.
• No Waiver: Failure to enforce a provision is not a waiver.
• Assignment: You may not assign these Terms without our consent. We may assign these Terms as part of a merger, acquisition, or asset sale.
• Force Majeure: We are not liable for delays or failures caused by events outside our reasonable control.

15. Abuse, Fraud, and Enforcement

We take abuse and fraudulent activity seriously.

If we determine, in our reasonable judgment, that an account or user is engaging in fraud, abuse, attempted abuse, or bad-faith use of the Services, we reserve the right to take immediate action. This may include, without limitation:

• Permanent suspension or closure of the account
• Termination of all associated services without refund
• Deletion of hosted data or content, where permitted by law
• Blocking future access or creation of new accounts

In cases of fraud or abuse, we reserve the right to permanently close your account and engage third-party collections services or initiate legal action to recover losses, including unpaid fees, chargeback costs, processing fees, investigative costs, and any other damages or expenses incurred as a result of the conduct.

Nothing in this section limits our right to pursue any other remedies available under these Terms, applicable policies, or law.
